Alimony

Burton & Reardon is a leading law firm specializing in alimony and spousal support representation for spouses and former spouses. Whether you’re going through an initial divorce or seeking modifications, our team of experienced attorneys can provide expert guidance and legal assistance.

Alimony, also known as spousal support, refers to the court-ordered payments made by one spouse to the other following a divorce or separation. Our attorneys at Burton & Reardon understand the complexities of alimony cases and can help you navigate through the legal process.

With the recent changes in tax laws, it’s important to note that starting January 1, 2019, alimony is no longer taxable to the recipient and must be claimed as income by the payer. However, for alimony awards established before this date and meeting IRS standards, the previous tax rules may still apply.

Determining alimony amounts involves various factors that the court considers. As outlined in NRS 125.150, these factors include the financial condition of each spouse, the nature and value of their respective properties, the duration of the marriage, the income and earning capacity of each spouse, the standard of living during the marriage, and other relevant considerations.

In addition to periodic alimony payments, the court may also award rehabilitative alimony, which aims to support a spouse in obtaining training or education for career advancement. This type of alimony considers factors such as the spouse’s job skills acquired during the marriage and the financial support provided by the other spouse for education or training.

When seeking to modify an existing alimony award, it’s essential to demonstrate changed circumstances. According to NRS 125.150, a change of 20 percent or more in the gross monthly income of the paying spouse may be considered as a basis for modification.

At Burton & Reardon, our attorneys have extensive experience in handling alimony cases and are familiar with the tendencies of different judges regarding alimony awards. We can provide personalized legal representation tailored to your specific circumstances.
