Legal Standard for Non-Parent Visitation  
Obtaining a court order for visitation as a non-parent is a specific and challenging legal process. The United States Supreme Court recognizes parental rights in visitation cases as constitutionally protected rights. The legal standard for filing a non-parent visitation petition is outlined in NRS 125C.050. 

NRS 125C.050 allows the district court in the county where the child resides to grant reasonable visitation rights to great-grandparents, grandparents, other children of either parent, and individuals with a meaningful relationship with the child. However, a party can seek visitation rights only if a parent has denied or unreasonably restricted visits with the child. 

Proving Best Interests of the Child
When seeking visitation, the party must prove by clear and convincing evidence that granting visitation is in the best interests of the child. The court considers various factors, including the emotional ties between the party seeking visitation and the child, the capacity to provide love, guidance, and material needs, the prior relationship, moral fitness, mental and physical health, child’s preferences, and willingness to facilitate a relationship with the parents.
